Sweepstakes period May 12-June 30, 2017, 2017. This Sweepstakes shall be subject to these Official Rules, and by participating, all participants agree to abide and be bound by these rules and the decisions of Station and any Sweepstakes judges or administrators selected by Station, which are final and binding in all respects. All entries to Sweepstakes must be received by 12:00pm, June 29, 2017.
Eligibility: This Sweepstakes is only open to legal residents of the state of South Carolina who are 18 years or older as of the first day of the Sweepstakes Period. Some prizes may require winner to be 21 years of age. Employees (and their immediate family or any persons domiciled with such employees) of Midlands Media Group, affiliates, subsidiaries, advertising agencies, other media companies, prize providers, promotion and delivery contractors and/or public relations companies associated with this Sweepstakes, are not eligible to participate or to win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, and in-laws, regardless of where they live. A potential winner will be requested to provide proof that all eligibility requirements are met.
How to Enter: To enter, during the Sweepstakes Period, register for the DUDE Flyaway Friday contest at www.943thedude.com prior to 12:00pm on June 29 2017 (see How to Play below). Each entrant must fully and accurately complete the online registration page with all required information including, but not limited to, his/her name, a valid email address and birth date. After having read and agreed to these Official Rules, click the submit button to submit your online registration. All online registrations must be completed fully to remain eligible to have your name announced on-air and to be a potential winner. Any online registration submitted with an invalid email address will be disqualified. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or other social media entity.
By entering, you acknowledge and agree that the Station may announce your name both on the air and on social media if you are randomly selected as a potential winner. You also acknowledge that you are submitting the sweepstakes entry on your behalf and not on behalf of any other individual.
Any registration submitted on behalf of another individual or using another person’s email address or name will be disqualified and ineligible to claim any prize. The use of multiple identities and/or accounts is prohibited, and any attempt by any participant to obtain more than the stated number of entries will void that participant’s registrations and that participant will be disqualified.
Station will not be responsible for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender, Station, or Station’s Sweepstakes application service provider.
In the event of a dispute, any questions regarding the number of registrations submitted or the authorized account holder shall be determined by Station in its sole discretion, and Station reserves the right to disqualify any entries by persons who submit false or misleading entry information or who Station determines to be tampering with or abusing any aspect of the Sweepstakes.
Prizes are non-assignable and nontransferable. Prizes will include roundtrip airline tickets. Some trips may include add-ons such as event tickets. Prizes not won and claimed by eligible winners in accordance with specified trip dates, OR, these Official Rules by July 31, 2017 will not be awarded and will remain the property of Station.
How to Play: Station will announce one winning name at approximately 9:00am each Friday beginning June 2nd through June 30, 2017 to win a Flyaway trip. Once the name is announced, the registrant will have 30 minutes to call 803- 742-9430 and claim their prize. In the event a person does not call within the 30 minute period, the Station will choose a random winner from all eligible entries and contact that winner by phone. If Station is not able to get the winner on the phone, Station reserves the right to call an alternate winner.
The Station make every effort to announce the winning name at the specified time but reserves the right to alter times within a reasonable period.
Any potential winner, claiming to be the registrant whose name was announced will need to verify his or her registration information, including the email address on his or her registration form, in order to claim his or her prize. In the event that multiple prize claims are made by individuals with the same names in response to an announcement, the prize will go to the individual whose email address and other information matches the information specified on the entry form. Winners selected are subject to verification of eligibility and compliance with these Official Rules.
Eligible individuals who listen to the Stations’ audio service via IP connections streaming or mobile devices are welcome to call-in. However, Station cannot be responsible for delays in electronic transmission of its Stations’ audio service to IP devices. By participating in this Sweepstakes, registrants acknowledge and agree to this specific provision of these Official Rules. In addition, Station will not be responsible for loss of service to the Sweepstakes line or for a participant’s failure to reach the Sweepstakes line due to malfunction of any network or system, congestion, any technical or human error, failures or malfunctions of any kind, including the congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call. In the event of interruption of power or telephone service to Station during a winner announcement for the Sweepstakes, the call-in period for the winner announcement affected by the interruption may or may not be replayed at the resumption of service, in Station’s sole discretion. If a designated caller is ineligible, or fails to comply with any term or condition of these Official Rules, that caller will not receive the applicable prize award. Any telephone calls placed to the Station’s phone line may be recorded for use on air any time.
Prizes: Flyaway Friday prizes for June 9, 16, and 23, 2017 each will include two roundtrip tickets to any direct destination that Columbia Metropolitan Airport flies – including Houston, Dallas, Atlanta, Charlotte, Washington DC, New York, Philadelphia and Chicago. Winner must book flights 21 days in advance and tickets must be used by October 31, 2017. Potential winners who do not follow these guidelines will forfeit their prize. The Station reserves the right to add, alter or substitute Flyaways at its sole discretion.
Limit: One (1) prize per person and one (1) prize per household for the duration of the Sweepstakes.
Prize Claim Procedures: Once a winner has been verified, the claimant must come to Station during pre-determined time and present a valid government-issued photo ID. The verification decisions of Station are final and binding in all respects. In addition, failure to present the required government-issued photo ID will result in forfeiture of the prize.
A winner may waive the right to receive a prize. Prizes are non-assignable and nontransferable. Winner may be required to provide his/her valid Social Security Number (or other taxpayer identification number Station deems acceptable) to Station for tax purposes and/or complete an IRS W-9 form in order to claim a prize. Winners are solely responsible for reporting and paying all federal, state and local taxes on the prize value and, if applicable, will be issued an IRS Form 1099 based on the prize value determined by Station. Prizes not won and claimed by eligible winners in accordance with these Official Rules by June 30, 2017 will not be awarded and will remain the property of Station.
By participating, participants agree to be bound by these Official Rules and the decisions of Station and any Sweepstakes judges or administrators selected by Station, which are final and binding in all respects. Station reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Station. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Station which corrupt or impair the administration, security, fairness or proper operation of the Sweepstakes, Station reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Station reserves the right to award prizes based on the eligible prize claims received before the termination date. Proof of sending or submission of an entry will not be deemed proof of receipt by Station.
Except where prohibited, acceptance of any prize constitutes the winner’s irrevocable consent to the publication or other use by Station and its licensees of his or her name, biographical information and likeness in any media, including the Internet, for any commercial, publicity or promotional purpose, without limitation, review or approval, or additional compensation.
Release: BY PARTICIPATING IN THE SWEEPSTAKES, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS STATION, MIDLANDS MEDIA GROUP AND ITS ENTITIES, FACEBOOK, AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE SWEEPSTAKES, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE SWEEPSTAKES; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE SWEEPSTAKES OR ANY PRIZE.
Limitations of Liability: By PARTICIPATING IN THE SWEEPSTAKES, PARTICIPANTS acknowledge and agree that EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING THE WEBSITES AND THE PRIZES, ARE provided “as is” and that Station makes no representations or warranties OF ANY KIND, express or implied, about the PRIZES and Station hereby DISCLAIMS all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTS, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT’S participation in the Sweepstakes or receipt or use or misuse of any prize.
Station reserves the right to amend these rules at it’s sole discretion.
