WWNQ 94.3 The Dude (“Station”) Song of the Day Contest

Contest Period: Contest starts on October 9, 2017 ends on November 3, 2017. This Contest shall be subject to these Official Rules, and by participating, all participants agree to abide and be bound by these rules and the decisions of Station and any Contest judges or administrators selected by Station, which are final and binding in all respects.
Eligibility: This Contest is only open to legal residents of the state of South Carolina who are 18 years or older as of the first day of the Contest Period. Employees (and their immediate family or any persons domiciled with such employees) of Midlands Media Group, affiliates, subsidiaries, advertising agencies, prize providers, promotion and delivery contractors and/or public relations companies associated with this Contest, are not eligible to participate or to win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, and in-laws, regardless of where they live. A potential winner will be requested to provide proof that all eligibility requirements are met.
Overview: The Station will assign a “Song of the Day” along with the related country artist to each weekday during contest dates. The Song will posted each weekday morning at approximately 7:00am and only apply to that date’s contest. A calendar of songs can also be found online at 943theDUDE.com.
How to Play: You must listen to the Station weekdays at 9:00am, 2:00pm and 5:00pm for the Song from that day’s designated Song/Artist. When you hear the Song, you must be the 9th caller at 803-742-9430 and upon confirmation of eligibility you will win $100. The caller will then be required to provide all information requested including complete name, phone number, address, date of birth and email.
In the event that the selected caller is disconnected or is found to be ineligible, the next eligible caller who successfully makes it through on the call-in line and is deemed eligible will be the winner. There is no limit to the number of times a listener may attempt to call in to win, but a listener may be a daily Prize winner only once for the duration of this contest period. The Song may be played up to three (3) times in a weekday; a total of sixty (60) chances to win.
Due to possible delays in the online streaming of the Station’s broadcast signal, entrants are encouraged to listen to the Station on-air. The Station is not responsible for online streaming delays which may cause a disadvantage for Contestants. The Station will not be responsible for loss of service to the Contest line or for a participant’s failure to reach the Contest line due to malfunction of any network or system, congestion, any technical or human error, failures or malfunctions of any kind, including the congestion, overload, busy signals, or any other factor that may prevent an individual from completing his/her phone call.
By playing, you acknowledge and agree that the Station may announce your name and voice both on the air and on social media. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or other social media entity.
Each winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
Entrants are required to provide truthful information; the Station reserves the right to disqualify any entrant who does not meet the eligibility requirements or who provides false fraudulent information.
Prizes: Up to Sixty (60) total daily prizes will be awarded over the duration of this contest. Each prize is one hundred dollars ($100).
All confirmed daily winners will be entered into a Grand Prize drawing to win a trip for two to the 2017 Country Music Awards in Nashville TN November 8, 2017. The trip includes roundtrip airfare for two from Columbia Metropolitan Airport departing November 8th, hotel accommodations and 2 tickets to the CMA Awards show.
The Grand Prize winner will be drawn and contacted by phone Friday, November 3, 2017 between 5-6:00pm. In the event there is no answer or winner is not available for any reason, we will move on and call the next name that is drawn to win the trip and so forth. Due to time sensitivity, the Grand Prize winner MUST be available by phone when we call to win the trip.
The winner(s) will be solely responsible for all taxes, fees and expenses not specified herein associated with the receipt and use of the prize(s). The prize(s) will not be awarded until winner has claimed the prize at the Station, presented all required documentation, and signed all required releases and tax forms. All prizes must be claimed at the Station during regular business hours. Daily winner(s) will forfeit any daily prize(s) not claimed within ten (10) business days of winning. Grand Prize winner will forfeit prize if not claimed with proper documentation by 5pm Monday, November 6, 2017. If Grand Prize winner is unable to travel, prize will be forfeited and may be awarded to another winner at the sole discretion of Station. No substitute or alternate prize will be given.
Prize(s) are not transferable, and no substitution, assignment or cash equivalent of prize(s) is permitted, except by the Station (solely at its discretion), which reserves the right to substitute a prize or prize portion with another prize or prize portion of greater or equal value. The prize(s) are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Station and any Promotional Partners are not responsible for winners’ limitations that prevent acceptance or use of prize(s). Entrants acknowledge that the Station and Partners have not made, and are not in any manner responsible or liable for, any warranties, representations or guarantees, and hereby disclaim any and all warranties, expressed or implied, whether by contract or law, concerning any prize, including without limitation, implied warranties of quality, merchantability, mechanical condition or fitness for a particular purpose. Other restrictions may apply.
Prizes not claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Station.
Prizes: A maximum of $6000 in cash prizes will be awarded during the Contest Period; however, the total dollar amount may be lower depending on the number of eligible entrants who call-in in response to the cue and successfully claim their prize. Each prize claim will be subject to verification of eligibility and compliance with these Official Rules. Limit: One (1) daily prize per person and one (1) daily prize per household for the duration of the Contest. One Grand Prize trip of approximately $1,500 value will be awarded unless Station is unable to secure an eligible winner for time-sensitive trip.
Prize Claim Procedures: In the event of a prize claim, the claimant must come to Station during specified time and present a valid government-issued photo ID.
A winner may waive the right to receive a prize. Winner may be required to provide his/her valid Social Security Number (or other taxpayer identification number Station deems acceptable) to Station or Promotion Partners for tax purposes and/or complete an IRS W-9 form in order to claim a prize. Winners are solely responsible for reporting and paying all federal, state and local taxes on the prize value and, if applicable, will be issued an IRS Form 1099 based on the prize value determined by Station and Promotion Partners.
By participating, participants agree to be bound by these Official Rules and the decisions of Station and any Contest judges or administrators selected by Station, which are final and binding in all respects. Station reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Station. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Station which corrupt or impair the administration, security, fairness or proper operation of the Contest, Station reserves the right in its sole discretion to suspend, modify or terminate the Contest. Station also reserves the right to, in its sole discretion, modify or amend rules during Contest period.
Except where prohibited, acceptance of any prize constitutes the winner’s irrevocable consent to the publication or other use by Station and its licensees of his or her name, biographical information and likeness in any media, including the Internet, for any commercial, publicity or promotional purpose, without limitation, review or approval, or additional compensation.
Release: BY PARTICIPATING IN THE CONTEST, EACH PARTICIPANT AGREES TO FULLY RELEASE, FOREVER DISCHARGE AND HOLD HARMLESS STATION, MIDLANDS MEDIA GROUP AND ITS ENTITIES, FACEBOOK, AND THEIR RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIMS, COSTS, LIABILITIES, LOSSES, INJURIES, AND DAMAGES ARISING OUT OF THE CONTEST, INCLUDING, BUT NOT LIMITED TO, ANY CLAIMS FOR PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, LOSS OF ENJOYMENT, OR ANY OTHER HARM WHATSOEVER ARISING OUT OF: (1) PARTICIPATION IN THE CONTEST; (2) THE QUALITY, RECEIPT, POSSESSION, USE, OR MISUSE OF ANY PRIZE; OR (3) ANY TRAVEL OR ACTIVITY THAT IS RELATED TO THE CONTEST OR ANY PRIZE.
Limitations of Liability: By PARTICIPATING IN THE CONTEST, PARTICIPANTS acknowledge and agree that EVERYTHING REGARDING THIS CONTEST, INCLUDING THE WEBSITES AND THE PRIZES, ARE provided “as is” and that Station makes no representations or warranties OF ANY KIND, express or implied, about the PRIZES and Station hereby DISCLAIMS all such warranties, including, but not limited to, any implied warranties of merchantability or fitness for a particular purpose.
The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by PARTICIPANTS, printing OR PRODUCTION errors, or by any of the equipment or programming associated with or EMPLOYED in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Contest; (4) technical or human error which may occur in the administration of the Contest, the processing of entries, or the notification of any winner; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from A PARTICIPANT’S participation in the Contest or receipt or use or misuse of any prize.
